SETTLEMENT AGREEMENT
This agreement is made between The City of Danbury (the "City") and the Danbury Professional Firefighters, Local 801, IAFF (the "Union"). In order to resolve the pending grievance concerning the provisional appointment of the Superintendent of Apparatus, the parties agree as follows:
1) 1) The requirement of firefighter will be removed from the job description of Superintendent of Apparatus and will be replaced by "bargaining unit member".
2) 2) The position of Superintendent of Apparatus will be a tested position and will no longer be an appointment by the Fire Chief.
3) Appointments to the positions of Superintendent of Apparatus and Assistant Mechanic will be based on the results of an examination consisting of both a written and practical component. The City shall use either CPS Human Resource Services will be conducted by neutral parties, and not employees of the City of Danbury or the Fire Department.
4) The written and practical exams for the position of Superintendent of Apparatus will be based on the minimum qualifications and responsibilities articulated in the "Revised November 1999" job description.
5) Joe Cavo will be appointed to the position of Superintendent of Apparatus on a provisional basis, in accordance with the contract.
6) The position of Assistant Mechanic will be posted and filled on a rotating basis until the examination process is complete. The Fire Chief will determine an appropriate rotating schedule that best meets the need of the Department.
7) The Union shall withdraw its Grievance 06-003 and shall not file any other grievance or claim arising out of same facts.
8) All parties acknowledge that they have read this Agreement, that they understand its terms and that they are entering into this Agreement voluntarily and without coercion.
9) This settlement is not an admission by the City that it violated the contract, and shall not establish a precedent for any other matter.
